California Pay Data Reporting Requirements (2023 Guide) – Forbes Advisor

If you’re required to submit a pay data report, you’ll need to provide the following pay data information about all your employees in California. You may also include pay data about your employees outside of California, but this is not a requirement.

NAICS code. Your pay data report must include your North American Industry Classification System (NAICS) code.

Job category. You’ll need to provide a count of your employees by race, ethnicity and sex in each of the following job categories for the Snapshot Period you’ve selected:

  • Executive or senior-level officials and managers
  • First- or mid-level officials and managers
  • Professionals
  • Technicians
  • Sales workers
  • Administrative support workers
  • Craft workers
  • Operatives
  • Laborers and helpers
  • Service workers

Pay bands. You’ll also need to provide a count of your employees by race, ethnicity and sex falling within each of the pay bands used by the U.S. Bureau of Labor Statistics in the Occupational Employment Statistics survey:

  • $19,239 and under
  • $19,240–$24,439
  • $24,440–$30,679
  • $30,680–$38,999
  • $39,000–$49,919
  • $49,920–$62,919
  • $62,920–$80,079
  • $80,080–$101,919
  • $101,920–$128,959
  • $128,960–$163,799
  • $163,800–$207,999
  • $208,000 and over

The numbers for employee earnings should be taken from each employee’s Form W-2 for the Reporting Year.

Hourly rate. For each of the job categories above, you’ll need to report the median and mean hourly rate for each combination of race, ethnicity and sex:

  • Median hourly rate is the midpoint rate in a sorted list of the hourly rates of employees counted within a job category
  • Mean hourly rate is the sum of the hourly rates of employees in a job category divided by the total number of employees in that category

As with pay band data, the numbers for employee earnings used to determine hourly rates should be taken from each employee’s Form W-2 for the Reporting Year.

Hours worked. The pay data report must also include the total number of hours worked by employees in each pay band during the Reporting Year.
